Kolchin A.A., Myshko Yu.A. Codification process in the sphere of soviet law: historical and legal aspect

The article is devoted to the history of the codification process in our country in the 1920s-1930s, which resulted in a system of socialist law that was fundamentally new in form and content, which actually existed until the collapse of the USSR in 1991 and differed from the generally accepted system of law. The relevance of the issues raised in the article lies in the need to rethink the experience of legal construction in our country, which today is of fundamental importance for assessing the relationship between Russian legislation and international law. The subject of consideration in the context of large-scale historical events of the 20th century was some examples of Soviet legal acts that became a political compromise between professional jurisprudence and the political attitudes of the Soviet state of a totalitarian type. To carry out the research we used an analysis of freely available legal documents, as well as a comparison of assessments of the codification process in Soviet Russia, and then in the USSR, representatives, first of all, of the legal community. The novelty of the approach here lies in the authors’ attempt to unequivocally point out the possibility of first creating a self-sufficient legal system within a single country, and then its long-term practical application. The conclusions drawn have practical significance and  can be used while  taking political and legal decisions in modern Russia aimed at forming an independent legal space in it in the context  of current geopolitical challenges.
